Terms of Service
1. Acceptance of Terms
By accessing and using Tourer, you agree to be bound by these Terms and Conditions and all applicable laws and regulations. If you do not agree with any part of these Terms, you may not access or use the Service.
You represent that you are at least 16 years of age. Tourer does not permit those under 16 to use the Service.
Your access to and use of the Service is also conditioned on your acceptance of our Privacy Policy.
2. Definitions
"Service" refers to the Tourer mobile application.
"Company" ("we", "us", "our") refers to the operator of Tourer.
"Account" means a unique account created for you to access our Service.
"Content" refers to text, images, trip itineraries, or other information posted through the Service.
3. User Accounts
When you create an account, you must provide accurate, complete, and current information. Failure to do so constitutes a breach of these Terms, which may result in immediate termination of your account.
You are responsible for safeguarding your password and for all activities that occur under your account. You must notify us immediately of any unauthorized use.
You may not use another person's name, a trademarked name, or an offensive or vulgar username.
4. User Content
You retain ownership of Content you create and post on Tourer. By posting Content, you grant us a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and distribute your Content within the Service.
You represent that: (i) the Content is yours or you have the right to use it, and (ii) posting it does not violate any third-party rights.
You may not post Content that is unlawful, offensive, defamatory, discriminatory, spam, malware, or infringes on intellectual property rights. The Company reserves the right to remove any Content that violates these Terms at its sole discretion.
5. Subscriptions & Payments
Tourer offers a Premium subscription that unlocks additional features. Subscription payments on iOS are processed exclusively through Apple In-App Purchase.
Subscriptions automatically renew at the end of each billing period unless cancelled. You can manage and cancel your subscription through your Apple ID account settings.
Subscription prices may change with prior notice. Price changes take effect at the start of the next billing period.
6. Cancellation & Refunds
You may cancel your subscription at any time through your Apple ID account settings. Upon cancellation, you retain access to Premium features until the end of your current billing period. No further charges will be made.
Refund requests for In-App Purchases are handled by Apple in accordance with their refund policies.
7. Suspension, Termination & Enforcement
Tourer reserves the right to suspend, restrict, or permanently ban any user account, at its sole discretion, without prior notice, for reasons including but not limited to:
- Violation of these Terms and Conditions
- Fraudulent or deceptive activity
- Publishing misleading or harmful content
- Any conduct deemed harmful to the platform, its users, or its reputation
You may appeal a suspension or ban by contacting contact@tourerapp.com. Appeals are reviewed on a case-by-case basis, and Tourer's decision is final.
8. Intellectual Property & Copyright
Tourer respects intellectual property rights. If you believe Content on the Service infringes your copyright, please contact us at contact@tourerapp.com with a detailed description of the alleged infringement.
You may be held accountable for damages for misrepresenting that Content infringes your copyright.
The Tourer name, logo, and all related marks are trademarks of the Company. You may not use them without prior written permission.
9. Limitation of Liability
The Service is provided "AS IS" and "AS AVAILABLE" without warranty of any kind. Tourer is not responsible for any damages arising from your use of the Service.
Tourer is not liable for: content accuracy, trip safety, third-party service outages, data loss, or any indirect, incidental, or consequential damages.
Our aggregate liability for any claims arising from your use of the Service shall not exceed the total fees actually paid by you in the 12 months preceding the claim.
10. Service Availability & Force Majeure
Tourer endeavors to keep the Service available at all times but does not guarantee uninterrupted access. Service may be temporarily suspended for maintenance, updates, or reasons beyond our control.
The Company shall not be liable for delays or failures caused by force majeure events including natural disasters, war, government actions, or internet infrastructure failures.
11. Changes to Terms
We reserve the right to modify these Terms at any time. Material changes will be communicated via the app or email with reasonable advance notice. Continued use of the Service after changes take effect constitutes your acceptance of the revised Terms.
If you do not agree to the updated Terms, you must stop using the Service.
12. Governing Law & Contact
These Terms shall be governed by applicable law. Any disputes shall be resolved through the competent courts of the applicable jurisdiction.
For European Union users: you will benefit from any mandatory provisions of the law of your country of residence.
